Jaime and Cassie grabbed Donald and raced for the hospital. They almost collided with Oscar who was coming out of Rudy’s office.
“Is there any change?” Jaime asked
“No. Rudy reported. I doubt there will be any change in the next twenty four to forty eight hours.”
“What happened?” Cassie quizzed.
“I’m not sure.” Rudy began. “He just slipped into a coma.” He thought for a moment. “Oscar said you had a bit of a breakthrough with Donald.”
The two women nodded. “As soon as he saw Hanson he started screaming.” Cassie explained. ‘I followed him to his room. He told me Hanson was the one who shot Steve.”
“He actually came out and said Hanson did it?” Rudy was skeptical.
“No. He cried ‘it was him’ I think that’s enough to…”
Rudy shook his head. “He could have been talking about anybody. He has had a huge trauma. Now don’t get me wrong I don’t doubt the Hanson did it”
“It’s just that we need more proof.” Oscar finished. I don’t think Donald’s testimony would hold up in court. That’s why we need Steve.”
“I understand.” Cassie and Jaime spoke together. “Besides, Don hasn’t uttered a word since.”
“That’s what I saying.” Rudy went on. “With Don’s problems it could have been anything.”
“I see.” Cassie sighed.
“I need to get back to Steve. You are all welcome to join us if you want.” Rudy offered
“What about the second operation.” Jaime reminded… the one to remove the bullet?”
“Not till he comes out of the coma.” Rudy informed
“Could that be why he’s in a coma?” Cassie pressed.
Rudy nodded. “That is very possible.” He noted.
/////////////////////////////////
At Steve’s house Oscar arrived and approached Hanson “anything yet?” He asked.
“I’m sorry Oscar there are just no leads.” Hanson sighed.
“I was hoping you had come up with something by now.” Oscar wanted to grab Hanson the throat and force him to confess.
“What about that kid?”
“That kid’s name is Donald. And he’s Steve’s son.” Oscar hissed. “What about him?”
“Did he see anything? Maybe we should question him.”
Oscar was instantly on guard. “No he hasn’t said anything. The boy has some problems.” Oscar added.
“What sort of problems?” Hanson was curious.
“He’s autistic.” Oscar thought adding this would keep Hanson from wanting to question Donald. Rudy had said if Hanson was the one to interrogate him it could put Don over the edge.
“Well I guess he won’t say anything then.” Oscar swore he saw Hanson smirk when he spoke.
“We’ll keep you informed Goldman.” Hanson moved away to rejoin the investigation team.
Oscar got in his car and headed back to the hospital hoping there was better news on Steve.
When he arrived Cassie and Jaime were sitting in Rudy’s office. Donald was writing on a notebook.
“Where’s Rudy?” Oscar asked
“He took Steve into surgery again.” Cassie told him.
“But I thought Rudy said…”
“He did.” Jaime interrupted. “But Rudy’s afraid that the bullet in his chest is what’s keeping him in a coma.”
“I understand how long has he been in surgery?”
“About a half an hour” Cassie explained. “Has Hanson come up with anything?”
Oscar shook his head “of course not. He’s not going to implicate himself” Oscar shouted.
“I guess you have a point there. But we do have Donald saying that it was Hanson Jaime reminded.”
No" Oscar stated. "From what you said he said it was him. “He didn’t mention Hanson’s name. As a matter of fact he didn’t even point to Hanson and say it was him. Hanson’s lawyer would have a field day with that one.”
Again both women nodded.
“Without Steve’s testimony I’m afraid Hanson is going to walk.” Oscar added.
Jaime walked over to where Donald was sitting. ..“if only he could tell us exactly what happened.”
“The way Rudy talks” Cassie moved to where Jaime stood. “He may never come back to where he was.”
“I know.” Jaime sighed. “I just wish I knew how to reach him.”
“We have to work on it.” Cassie put her arm around Donald. Don shrank away. “What’s this?” She asked looking at the numbers that Donald had written all over the notebook. Klj145. Donald had written it on every line of the page and several pages before that one.
Cassie took the notebook and handed it to Oscar. “It looks like a license plate number.”
Oscar took the notebook from Cassie. “It sure does. I’ll run the plates.” He picked up the phone and dialed. “Yes this is Oscar Goldman speaking” Oscar stopped ‘no wonder the kid thinks my last name is Speaking.’ He thought.
“Yes Mr. Goldman This is Kim Ruth, what can we do for you?: Kim asked.
“I need you to run a plate for me…anyway I think it’s a plate.” Oscar requested.
“That’s what we’re here for. “Kim chirped, what’s the number?” The woman asked.
“Klj145” Oscar told her
“I’ll run that right away Mr. Goldman. Give me five minutes.”
“I’ll call back then.” Oscar hung up the phone. “She said it would take about five minutes.” Oscar looked from Jaime to Cassie and then to Donald who continued to write klj145 on anything he could find.
“He’s really serious about this.” Oscar thought for a moment. “Did he see Hanson’s car at Steve”s?” He wondered.
Cassie turned to Jaime. “I don’t believe he did.” She replied
“I’m positive he didn’t” Jaime added.
“Well that’s good. He had to have seen it when Hanson shot Steve.” Cassie added
“If only Steve could tell us that.” Oscar muttered. “We don’t even know if that’s Hanson’s license number.” He continued.
They were interrupted when the door opened. Thinking it was Rudy they all turned toward the door.
“Oh hi Conner” Oscar spoke. “Cassie this is Ben Conner He’s the director over at the FBI… and the lead investigator in the shooting.”
The two nodded their acknowledgement of him.
“Oscar.” Conner began “I understand that Donald may have witnessed the shooting.”
“It’s possible.” Oscar answered. “Then whispered to Jaime hide the notebook.”
Jaime busied herself picking up the papers on Rudy’s desk including Donald’s notebook and put them in the drawer.
“Donald has some emotional problems.” Oscar continued. “He’s autistic. I don’t know what if any help he would be.”
“I understand but maybe we can reach him.”
“Dr. Wells doesn’t think that would be a good idea.” Oscar warned. “You see Donald has regressed Rudy feels it could actually do more harm than good. He isn’t even talking right now.”
“I see but I think it could help us out. We have the best psychologists in the country working for us. We might be able to help Donald.”
“I think Rudy can handle it. Oscar moved toward the boy. I know Steve. He’d want Donald to stay here with me.”
Conner reached into his suit coat pocket. “I’m afraid I have a court order. He produced the document for Oscar. I need to take Donald with me now.”
Oscar had no choice but to give in and Conner walked out of Rudy’s office with Donald.
“Oscar! How could you?” Jaime and Cassie both shouted at him.
“He had a court order. I didn’t have a choice. He glanced down at his watch I better call Kim Ruth Back.”
“Who’s that?” Cassie asked.
“The woman at the DMV she’s running the plate numbers.” Oscar reached for the phone, picked it and dialed. “Yes could I speak with Kim Ruth?” He asked.
“This is she” Kim spoke. “Is this Mr. Goldman?”
“Yes. Oscar replied. What did you come up with on the plates?”
“Those plates belong to Jack Hanson.” Kim informed him.
“Thank you.’ Oscar’s voice was barely audible.
Cassie and Jaime stood looking at him. “What is it Oscar?” They both asked.
“The plates do belong to Hanson.” Oscar told the stunned women.
“That means…” Jaime started.
“That Hanson is the one who shot Steve.” Cassie finished.
Jaime walked over to the window and looked out. “Oh my g*d Jaime screamed.”
Oscar and Cassie joined him at the window. They stared in horror as they watched Ben Conner turn Donald over to Jack Hanson in the parking lot.
(6)
Jaime leaped out of the window while Cassie ran for the elevator. Jaime reached the parking lot just as Hanson pulled out of the parking lot.
She would have gone after them but there were too many people on the street. Jaime was afraid that they would see her.
Cassie caught up to her just as she was headed back. “They got away?” She asked
Jaime nodded. “By the time I got here they were out of the parking lot.” Jaime pointed to the masses of people milling about the street. “I was afraid someone would see.”
“I understand.” Cassie sighed. “Where do you suppose he took him?”
“I don’t know.” Jaime moaned “NSB headquarters I suppose.”
Cassie nodded.
“Is there a problem ladies?” Conner walked over to where they stood.
“It’s just that we suspect Hanson of shooting Steve.” Cassie explained.
Conner stared at the two women. “Do you have any proof?”
“We have some, most of it circumstantial right now, Donald is our only witness”. Cassie continued.
“Show me the proof you have. We could go to the NSB and get Don back.”
Cassie and Jaime led Conner back up to Rudy’s office. “First of all Jaime began. When he saw Hanson he screamed and ran to his room.”
“I followed him, when he calmed down enough he said it was him” Cassie added
“He didn’t say Hanson did it though?” Conner pressed.
The women shook their heads. “I’m afraid not. But…” Jaime reached into Rudy’s desk drawer and pulled out the notebook “Don had been writing on. He wrote this over and over. Its Hanson’s plate number. We checked it out.”
“Conner took the notebook. Well like you said circumstantial but enough to get Donald back here. Well go to the NSB and get him.”
“Thank you.” Cassie and Jaime echoed.
////////////////////////////////
“I think just to be on the safe side I’ll have Hanson taken off the case for now.” Conner added before he left to pick up Donald at the NSB.
They were still waiting for him to return when Rudy stepped in. They all jumped they had forgotten Steve was in surgery.
“How is he?” Cassie demanded.
“Stable” Rudy reported. “I removed the bullet and he’s resting.”
“You mean he’s no longer in a coma?” Jaime asked.
“He’s just sleeping now.” Rudy assured.
“Well that’s a relief.” Oscar added.
“When can we see him?” Cassie and Jaime asked.
“Hopefully first thing in the morning” Rudy looked around the room. “Where’s Donald?”
“Long story” Oscar began. “He’s with Hanson. The FBI went to see if they could get him back.”
They all turned as Conner walked back into the room. “He wasn’t at the NSB.” Conner sighed. “I’m sorry, I never should have let him take the boy. He said he wanted to question the boy about the shooting.”
“You didn’t know.” Jaime tried to sound understanding but actually she was furious.
//////////////////////////////////
At Hanson’s house Hanson sat a frightened Donald on the couch. “Now” Hanson began. “You’re going to tell me exactly what happened!” He shouted.
Don sat on the couch rocking back and forth and staring blankly at the wall in front of him.
“Fine don’t talk.” Hanson hissed. “But you’re going to stay here. It was an accident. I’m not going to have my career ruined by some snot nosed kid.” He turned and stomped off leaving Donald alone.
Don watched as Hanson left the room. He stood and walked over to the telephone, lifted the receiver and dialed Oscar’s private number at the OSI.
In the outer office Callahan heard the phone ring. Since Oscar was out of the office she went to answer it. “Oscar Goldman’s office she spoke. Don set the phone down half off the cradle and went back to the couch.
She was about to hang up when no one responded. Then she heard a man’s voice “ok son were going to try this one more time.” Hanson’s voice was a bit softer.
Don didn’t even look at him. He just sat on the couch rocking.
“Listen Don just tell me what happened.”
Callahan laid the phone down on Oscar’s desk and ran out to the outer office where she dialed Rudy’s number at the hospital.
////////////////////////////////////////////
Jaime and Cassie were still trying to convince Conner it wasn’t his fault when the phone rang. Rudy picked it up “Hello.”
“Dr. Wells? Its Callahan is Mr. Goldman there?”
“Yes he’s right here just a…”
“No you don’t need to put him on…just tell him to get to his office right away. Donald is on the phone and…”
“We’re on our way!” Rudy shouted “Trace the call just in case the line is cut before we get there.” Rudy ordered.
“I will.” Callahan assured.
“What was that?” Oscar asked.
“That’s Callahan, Don called your office.”
///////////////////////////////////////////
Oscar, Jaime, Rudy and Cassie all raced to Oscar’s office. Callahan was waiting for them just outside the door. “The line was cut but Russ has the address.”
Russ was walking down the hall. Its Hanson’s house. Russ informed.
Let’s go. Conner ordered. I’ll go with you.
////////////////////////////////////////
Forty minutes later Russ appeared with a very frightened. Donald.
“I’ll take him back to Steve’s” Cassie offered. “Are you coming Jaime?”
‘I want to see Hanson first and I want to talk to Callahan. I’ll be there in a bit.”
“Ok then. I think we need to get him back to normal as much as we can.” Cassie suggested.
“I agree.” Jaime nodded.
“Callahan, what did Don say to you on the phone?” Jaime asked.
“He didn’t say anything. I just heard Hanson talking to him.” Callahan told her.
Jaime was about to ask more questions when Conner arrived with Hanson.
I want to be with you when you question him. Jaime told Oscar.
“That might be a while. He won’t say a word without a lawyer.” Oscar explained hanging up the phone. “That was just him. He’s in NY right now but says he’ll be here first thing in the morning.”
“Ok” Jaime sighed. “I’m going to go over to Steve’s and See how Cassie is getting along with Donald.” She turned to Rudy. “Call there if there is any change.”
“You know I will.” Rudy assured. “Before you go I need to tell you something. Without Steve conscious help Hanson could walk.”
“What?” Jaime questioned.
“I’ve talked to several friends who are in this field. Also with some legal experts, unless Donald can get in court and say “I saw Hanson shoot Steve…or whatever Donald calls him, then we don’t stand a chance. And if Hanson is found innocent we can’t retry him because of the double jeopardy rule.”
“Well it will be a while before we go to court anyway.” Jaime sighed.
“Don’t count on that.” Oscar interrupted. “When I was speaking to Turner…that’s Hanson’s attorney. He wants this in court as soon as possible.”
“Wonderful!” Jaime griped “Donald is nowhere near ready.”
“That’s what Hanson is counting on.” Oscar moaned.
“I’ve got to tell Cassie. Maybe between the two of us we can help Donald. He may be Steve’s only chance.” Jaime hurried out the door.
When she arrived at Steve’s, Cassie and Donald were sitting on the couch. Donald had his sketch pad out and was writing klj145 on as many times as he could on each page.
“Any luck?” Jaime asked.
Cassie shook her head. “That’s all he does. Jaime he used to speak. He never really looked you in the eye but he responded to you. You would ask him a question he would reply with the appropriate response. Actually he was quite bright considering.”
“That’s not our only problem. Jaime informed Cassie of what Rudy had said about Don having to say that Hanson had shot Steve. And Jaime continued. “Hanson wants the trial as soon as possible.”
“That figures. Cassie hissed. He wants to make mince meat out of Donald then be found not guilty.”
“This really burns me. Hanson will more than likely get away with this.” Jaime fumed.
“Look we’ll work with Donald. I know what he was like before. He knows me. Hopefully that will be enough.”
“Let’s hope so.” Jaime sighed.
///////////////////////////////
Back at the hospital Rudy walked into Steve’s room for his usual check on his patient. Steve still lay slumbering but something was different. His head is in a different position. Rudy noted. He stepped closer to the bed. “Steve?” He called out.
Steve moaned slightly. Rudy moved even closer. ‘Did I hear that… or did it come from outside?’ Rudy was now right next to Steve. “Steve? Can you hear me?” Rudy asked.
Steve’s lips moved but what he said was inaudible.
“Steve if you can hear me open your eyes.” Rudy requested.
Rudy watched but Steve’s eyes remained closed but his lips continued to move in his silent plea.
“Hang on Steve I’ll be right back!!” Rudy’s voice was more commanding than he intended.
He made the phone call from Steve’s room but before calling Cassie and Jaime he called Oscar. “Oscar its Rudy. Steve is conscious!” He cried into the phone.
“Are you serious?” Oscar blurted when Rudy told him.
“Yes I am.” Rudy continued. “He’s barely conscious though. He’s trying to tell me something but I can’t hear him. I’m going to call Jaime and hopefully she will be able to hear what he’s trying to say.”
“Good idea. Tell her I’m sending an escorted car right now. They’ll bring her. Then I’m on my way over.”
“I’ll do that.” Rudy was already dialing Steve’s number.
////////////////////////////////
Donald had finally succeeded in filling his entire sketch pad with klj145 when he finished, he threw it on the floor, and started flapping his arms wildly.
“I’ve never seen him like this Jaime.” Cassie declared.
“I never knew what he was like to begin with.” Jaime noted “except for what Steve told me.”
“Well he wasn’t like this.” Cassie told her. They were interrupted when the phone rang.
“Maybe it’s Rudy with some news.” Cassie exclaimed.
“I bet it is.’ Jaime agreed. “I told him to call here if there was any change.”
“I’ll get it.” Cassie picked it up. “We’ll be right there.” She hung up and turned to Jaime. “Steve is conscious.”
The two raced with Donald to the hospital. Rudy met them getting off the elevator. “Now don’t get your hopes up. He’s just barely conscious.” He turned to Jaime. “He’s trying to tell me something but I can’t hear him. I was hoping you could.”
“I’ll sure try.” Jaime, Cassie and Don followed Rudy to Steve’s room.
Before they entered Rudy turned to Cassie. “You better wait here with Donald. I don’t want him to see Steve this way.”
“I understand.” Cassie agreed.
Jaime entered the room with Rudy who could tell Steve had been moving around even more than before. He stepped close to Steve. “Steve, Jaime is here. She’ll be able to hear you.”
Jaime bent close to Steve moving lips and listened.
“Wh…wh…where am I?” Steve asked.
“You’re in the hospital. Jaime replied.
“Wh, wheres Don…Don…Donald?” Steve asked.
“He’s outside with Cassie.” Jaime explained.
“Why hospital?” Steve continued to whisper to her.
“You were shot.” Jaime told hm.
“By who?” Steve asked.
“We were hoping you could tell us.” Jaime sighed.
“I don’t remember it at all.” Steve’s voice drifted and he fell back to sleep
(7)
Rudy and Oscar stood by without saying a word. When Jaime stood Rudy and Oscar moved to where she stood.
“I heard you tell him he’d been shot. Rudy observed, what was his response?
Jaime shook her head. “He doesn’t remember anything.”
“I was hoping he’d have said he had.” Rudy sighed.
“I know.” Me too Jaime agreed. “He was more worried about Donald. I told him he was with Cassie.” She motioned for everyone to go out of the room. “I didn’t want Steve to hear. I didn’t tell him that Don is having problems.”
“That was probably a good idea.” Rudy agreed.
“Well?” Cassie asked approaching everyone.
“He asked where he was and why.” Jaime told her. “He has no recollection of the shooting at all.”
‘So then I guess it’s up to Donald.” Cassie sighed.
“I don’t know if he’ll be able to do much of anything.” Rudy added. The way his now, he’d never be able to stand up under the pressure of a cross examination.”
“Well then we better get started working with him.” Cassie stated.
“It will have to be quick.” Oscar informed. “Hanson has been officially charged. The trial is a week from tomorrow.”
“I don’t think we can possibly…” Jaime began.
“Oh yes we can. Come on Jaime we have work to do.” Cassie grabbed Don by the hand and the three headed for the elevator.
//////////////////////////////////////////////////
They went back to Steve’s house which was no longer a crime Scene. The units from the OSI, NSB and FBI were all gone and they had access to the entire house.
Cassie and Jaime sat Donald on the couch. “Come on honey.” Cassie coaxed. “We need you to tell us what happened. I know you’ve tried in your own way to tell us it was Hanson. But we need you to be able to tell it to a judge. Do you understand?”
Don sat on the edge of the couch flapping his hands.
“If only somehow we could reach him. Jaime sighed. I just don’t see how there is any way he can testify.”
“I agree.” Cassie relented.
“I mean we have less than a week before the trial. If Donald doesn’t speak Hanson walks.” Jaime continued.
Donald glanced ever so slightly in Jaime’s direction.
“Did you see that?” Cassie asked.
“No, what?” Jaime wondered.
“He looked at you. If only for a second he responded when you said Hanson’s name Cassie’s voice rose with excitement.
Jaime watched as Donald once again glanced at Cassie when Hanson’s name was mentioned.
/////////////////////////////////////
It was late evening when Rudy walked into Steve’s room. He intended to examine Steve one more time before calling it a night and retiring for the evening.
He walked over to Steve’s bed and to his surprise Steve’s eyes popped open.
“Steve?” Rudy questioned.
Steve nodded slowly.
“Do you know where you are?”
Again Steve nodded. “Jaime told me.”
“That’s right, do you remember her being here?”
“Yes.” His voice was very weak but Rudy could hear what he was saying now.
“That’s good. Don’t try to talk anymore tonight. You sleep. You might be a little stronger in the morning.”
Steve nodded, gave Rudy a weak smile and drifted back to sleep.
///////////////////////////////////
At breakfast the next morning Cassie and Jaime noted a remarkable change in Donald. Although he still wouldn’t speak, he responded by either nodding or shaking his head in response to their questions.
“I’m going to call Rudy and tell him.” Jaime said. “I mean Donald is so much better.”
“Ask how Steve is.” Cassie called after her.
“That’s my main reason for calling.” Jaime called back.
As they spoke Donald looked from one to the other.
“He’s following the conversation? Cassie remarked to herself. I wonder She turned to Don and tapped him on the shoulder, “Donald do you understand what I’m saying?”
Donald gave a slight nod.
“Good. Listen honey you have to tell us…especially the court what you saw. Otherwise that bad man will not go to jail for hurting you dad.”
Again Donald looked at her as she spoke but he remained voiceless.
///////////////////////////////
“...That’s great Jaime. Rudy said in response to what Jaime had just told him. “But he still needs to get on the witness stand and swear to tell the truth. Then he has to say what happened.”
“We’re doing the best we can.” Jaime barked.
“Hey! Rudy defended himself. “Don’t take it out on me. I didn’t make the law.”
“I’m sorry Rudy. I was just hoping for a better response. How’s Steve by the way?”
“When I checked him he was sleeping…”
“Just sleeping…right?”
“Yes. The nurse I assigned said he ate all of his breakfast by… himself.”
“Well that’s a start. Sounds like he and Don are on the same page.” Jaime gave a slight laugh. “Well be by later.”
“Ok, see you then.” Rudy hung up and headed back to check on Steve.
“I suppose we better go.” Jaime stated after finishing the breakfast dishes. “I think Rudy may change his mind about Donald as soon as he sees him.”
“I think so too. He dressed himself too.” Cassie noted.
“He hadn’t done that before?” Jaime was startled by the remark.
“Well not since… since…well you know.” Cassie was trying to refrain from saying anything that might put Don back over the edge. He seemed to understand everything that was said now and she just didn’t want to risk it.
“I understand.” Jaime agreed.
“Did Rudy say how Steve was doing?” Cassie whispered.
Jaime nodded and gave her a thumbs up. “I just hope going to the hospital doesn’t upset him.”
Cassie nodded her agreement as they got into the car. Don slid into the back seat. Just as Cassie was ready to put Don’s seat belt on he grabbed it himself and latched the buckle.
“The old Donald is back.” Cassie remarked as she slid into the driver’s seat.
“Except he won’t talk” Jaime reminded. “Rudy says he has to.”
“Yeah I know.” Cassie sighed. “We still have the weekend.”
“Hopefully something will come then.” Jaime muttered.
///////////////////////////////////////
“I can’t believe the change.” Rudy commented after a quick examination of Donald. “He seems to have come out of the trauma.”
“Then he can testify?” The two women asked.
“Don’t count on that. Don has come a long way. But he may never speak again. It was wonderful thing that he spoke at all.” He added.
“He’ll do it I know he will.” Cassie reached out to ruffle Donald’s hair. Don shrank away.
“Don’t you like that?” Cassie asked.
Don shook his head.
“See Rudy he responds when you ask him.” Cassie noted.
“I know. And that’s a good thing. But he has to talk in court.”
“I suppose you’re right.” Jaime and Cassie heaved a sigh.
“Let’s see what the weekend brings.” Cassie continued.
“Let’s go see Steve.” Jaime offered.
Wonderful.” Cassie agreed. “Rudy will you watch Donald.”
Rudy nodded as the two headed for the door. “I think you’ll be surprised in his change too.” Rudy smiled.
“Hi”. Steve smiled at them when they walked in. “How’s Donald?”
“He’s better. He’s having a rough time with this.’ Cassie began.
“Rudy told me. I just wish I could see him.” Steve moaned.
“I know.” Jaime spoke “But Rudy says it could harm him seeing you like this…”
“It’s hard enough for us.” Cassie smiled at him.
“I suppose you’re right.” Steve agreed.
“How about the shooting, do you remember anything…anything at all?” Cassie hoped something had come back.
Steve shook his head. “I wish there was something. Poor Donald going through this alone at least he has you and Jaime for now.”
“We’re trying to get him ready for the trial.” Jaime explained.
“No. I don’t want you to put him through that. Steve ordered. He’s had enough of a trauma much less going up against Hanson’s team of lawyers.”
“But Steve it’s the only way to convict him. We might as well just let him go without a trial then” Cassie argued.
Steve thought for several minutes. “Well I suppose…only if Rudy thinks he’s ready.”
“Well that’s the problem.” Jaime added. “Don refuses to speak. He has to talk in court.”
“Well then.” Steve sighed with relief. “I guess that’s that.”
“If we can get him to talk” Cassie asked. “Can he testify?”…
end
Slowly Steve nodded. “I suppose.” Steve thought a moment. “But only if he can talk.”
“Agreed” Cassie gave him a light kiss “I’ll see you in the morning, Jaime and I will keep working with him.”
“Thanks for taking care of him. I guess you are officially his nanny.” Steve smiled.
/////////////////////////////
The weekend came and went. On Sunday night Rudy entered Steve’s room. “So how are you doing?”
“Bored out of my skull” Steve protested. “When can I get out of here and get home to my son?”
“I was thinking of tomorrow morning. I know your’e going to want to go to the trial…”
“Is Don going to testify?” Steve asked.
“Oscar and the prosecutor don’t want to put him on the stand.” Rudy sighed. “I mean Don has made excellent progress up till now. I just don’t want anything to harm that.”
“Well then why is he going to testify?” Steve continued.
Rudy shrugged. “It’s Hanson and his lawyer who want him on the stand. I guessthey’re afraid that the jury may have heard Don accused him…”
“They want to humiliate him.” Steve seethed. “I won’t let them.”
“You don’t have a choice.” Rudy continued to sigh. “Hanson has the right to question his accuser in court. Remember it’s on Donald’s hearsay that Hanson is in jail in the first place. If they can attack him they wind up with a lawsuit of their own to file.”
Steve nodded “I understand what you’re saying. I want to be there for him. What time is the trial?”
“It starts at ten.” Rudy informed.
“Where is Donald now?” Steve wondered.
“He’s staying here. Oscar doesn’t want anything to happen to him before the trial.” Rudy explained.
“Can I see him?” Steve asked.
“I guess I’ve kept the two of you separate long enough.” Rudy nodded “I’ll go get him. Before he left he turned to Steve “he still won’t talk I doubt that he ever will speak again, but he responds by nodding or shaking his head to yes or no questions.”
“I understand.” Steve sighed as Rudy left to get his son.
A few minutes later Rudy escorted Don into the room. “He’s very excited to be here. I’ll leave the two of you to get reacquainted.”
//////////////////////////////////
“Hey buddy” Steve looked at the boy standing next to him. “Sorry about all of the trouble.”
Don nodded.
“Are you ok?” Steve asked trying to keep his questions to yes or no replies.
Again Don nodded. Then he moved over to Steve and held on to him. He fell asleep with his head on Steve’s chest.
////////////////////////////////
In the morning everyone was up early to go to court. “I still don’t like it Oscar.” Steve protested as they got into the car. “Donald is in no condition to get on the witness stand.”
“It’s not me Steve.” Oscar argued. “It’s Hanson.” He reminded.
“Yeah I know. I’m sorry.” Steve apologized.
The trial began Steve’s lawyer Ben Mason didn’t quite nowhere to start. He called Don to the stand first.
“Now Donald did you see someone hurt your father?”
“Don nodded.”
“Is he in the courtroom?” Mason asked
Again Don nodded.
“Can you point to him?” Mason pressed
Don pointed straight at Hanson.
“Thank you Donald.” He turned to the judge…now more questions.”
The judge turned to Hanson’s lawyer. “Ok Turner. But remember go easy he’s just a kid.”
“Don’t worry your honor.” Matt Turner stood and approached Donald. “Now Donald, tell me what you saw. You didn’t really see Mr. Hanson shoot Col. Austin did you?”
Donald stared at him for several minutes trying to understand the Question Turner had just asked him.
“We’re waiting for your answer.” Turner stared at Don. “Come on speak up the court wants to hear what you have to say!!”
The confusion running through Donald’s head grew. He wasn’t sure how to respond. ‘Didn’t and see Mr. Hanson shoot Col. Austin’ wasn’t registering.
Several minutes passed. The courtroom remained silent. Turner turned to the judge. “I have no more questions for Don at this time.” Smiling triumphantly he headed back to the defense table. He leaned over to Hanson. “Should I say I rest my case?” He was practically laughing.
Steve stood and was about to approach the stand to help Donald
“Its…its…its Donald.” Donald replied his voice a whisper.
“What was that?” The judge turned to Don. “Did you say something?”
“My…my…my name is Donald…not Don.”His voice was slightly louder now.
Steve sat back down.
Turner rose to readdress the child.
“Sit down Turner!!” The judge admonished. “For you antics in dealing with this boy you will be fined $5,000. Do I make myself clear?”
Turner nodded
“Speak up turner the court can’t hear you.” The judge was furious at him.
“Yes your honor I understand.” Turner sat down next to his client.
The judge turned to the court. “I will question young Donald here myself.” He glared at the attorneys “Any objections?”
“No your honor” Mason said.
“I have an objection.” Turner spoke.
“And what would that be?” The judge shouted.
“He probably doesn’t even know who or what you are.”
“You have a valid point Turner.” He turned to Donald. “Do you know what I am?”
Don nodded. “You…you…you are a judge.” Don was looking straight at him but never made direct eye contact.
“That’s right. Do you know what a judge does?” The judge continued to question.
“A..a…a judge says if people go to jail or not.” Don gave a slight smile. He flapped his hand to the side but he was looking at the judge.
“Very good the judge added. I have just a couple of more questions. Is that ok?”
Don nodded.
“Do you know the difference between the truth and a lie?” The judge coninued
“My…my…my name is Tommy. That is a lie.” Donald stated
“Very good, now this is my last question…well maybe not so much a question rather …”
“Your honor!” Turner stood to object
“That’s enough out of you! Interrupt one more time and I add to your fine!” Much calmer he turned back to Donald. Now can you tell me what happened last Saturday night?
Don nodded. “Yes…yes…yes your honor. I…I…I saw Mr. Hanson shoot Mr. Steve.” Don looked straight at the judge
“Your honor.” Turner interrupted.
“What is it Turner?” The judge was growing angry.
“My client wishes to amend his plea…It was an accident.” Turner tried.
And if I believe that is there a bridge in Brooklyn you”d like to try and sell me? Sit down!”
“Yes sir.” Turner sat back down.
The rest of the trial didn’t take long. The jury went out the next morning and came back with a guilty verdict.
/////////////////////////////
A month later Rudy cleared Steve to start going on missions. Cassie moved in to help out with Donald and Jaime flew back to Ojai. They never did get around to celebrating Helen and Jims anniversary. Helen and Jim both agreed that Steve being alive and safe was the best present they could get.
A week or so later Cassie, Steve sat in their living room Mrs. Martin sat across from them. “Well we are half way to the six month mark how is everything going?”
“Everything is great!” Steve informed. He reached for a folder sitting on the table. “This
is Donald’s school records.” He handed it to her. “As you can see he’s doing very well.
Mrs. Martin glanced through Don’s school work and looked at the notes from his teacher
and principal. “Yes he’s doing as well as if not better than before.” She noted
“I’m pretty proud of him” Steve beamed.
“I can see that.” The social worker smiled. I’ve been trying to get a home for Donald for years. I think I’ve finally found one.
“Thanks.” Steve said “I don’t know there is just something about him. I’ve felt it ever since I met him.”
“Well in another three months the adoption will be final and he’ll be you son.” Mrs. Martin added
“That will be great.” Steve stood and showed her to the door. “Thanks for dropping by.”
“No problem. I’ll be in touch as to the court date and all.” Mrs. Martin walked down the porch steps, got into her car and drove off.
“She seems very nice.” Cassie noted.
“She is.” Steve agreed
///////////////////////////////
The next night Cassie and Callahan went out for dinner. Steve and Don sat alone eating TV dinners.
“Do…do…do you like Mrs. Cassie?” Don asked.
Steve nodded “Yeah how about you? And try to start you sentence with only one word like Dr. Maxwell is teaching you.” Steve referred to the speech therapist Rudy had found and he had hired to curb Don of just that habit.
Don nodded. I think she’s nifty.” Don’s words were slow but he managed to speak without the stutter.
“I think she’s pretty nifty to.” Steve smiled.
“I…think… you…should ask her to marry you.” Don suggested.
“I already have…she said yes.” Steve continued
“Yeah!!” Don shouted.
/////////////////////////////////////
A week later the adoption was final. The judge married Steve and Cassie before the finalized the adoption.
“This way you are his mother.” The judge explained. “If the two of you want you can get married later with all the trimmings. I would just like to see Donald have a legal mother as well.”
“Thanks your honor.” Steve waved as they left the court room with Donald’s adoption papers with he and Cassie’s names on it, as well as their marriage certificate.
“I don’t think we’ll bother the other way” Steve started
“Think again Col.” Cassie smiled.
An hour later they dropped Don off at school. They got out of the car and watched as their son headed up the sidewalk. Just as he was ready to open the door two boys approached Donald.
Who was that? Bobby asked pointing to Steve and Cassie.
“That’s…my… mom and dad. Don beamed.
THE END
/////////////////////////////////
////////////////////////////////
//////////////////////////////////
////////////////////////////////////////////
///////////////////////////////////////////
////////////////////////////////////////
///////////////////////////////
////////////////////////////////
//////////////////////////////////////////////////
/////////////////////////////////////
///////////////////////////////////
///////////////////////////////
///////////////////////////////////////

/////////////////////////////////////
Don beamed.
